Regulatory Compliance and Enforcement

Regulatory frameworks are constantly shifting across business sectors in Arizona and around the world. As the demand for transparency increases, the costs of non-compliance with laws and regulations also increases. This requires businesses everywhere to adapt in response to the mounting pressure and oversight from regulatory bodies. We deliver proactive and responsive advice and risk assessments, assist with day-to-day business transactions, counsel on the applicability and effect of regulations, and provide guidance on how to mitigate the risks of potential enforcement actions. We also assist clients to build effective and practical internal compliance programs with the goal of reducing risk, while ever focusing on business goals.

We advise and represent clients on regulatory compliance in several ways, including:

One, understanding the regulations,
Two, developing policies, procedures, manuals, handouts, and handbooks for compliance,
Three, challenging, or seeking an exception to, the regulations as written, and
Four, defending the clients against accusation of regulatory violations.

An understanding of regulatory law is imperative to remain in compliance with guidelines for operating your business. A failure to comply can have serious consequences that can cost you financially, lead to criminal charges, or a shut-down of business operations. Understanding and complying with regulatory guidelines is always the best option, but in some cases, challenging regulatory rules or seeking exemptions is necessary to achieve desired business goals. In still other situations, accusations of regulatory violations must be met with aggressive defenses or effective negotiation of resolutions.

We understand regulatory law and can assist with the development of compliance manuals, programs and training that can substantially limit the risk of regulatory violations. If, however, accusations of regulatory violations arise, or if you wish to argue for an exemption or an exception to standard rules, we can help.
