  • Failure to pay the agreed upon price
  • Failure to deliver the agreed upon goods or provide the agreed upon services
  • Failure to provide the quality of goods and services sufficient to satisfy an express or implied warranty
  • Where the contract provides that time is of the essence, the failure to deliver or provide goods or services or pay by the agreed upon deadline

It is not necessarily the case that a party must violate the express terms of the contract itself in order to be liable for breach of contract.
